Welcome to From Earth. The terms “we”, “us” and “our” refer to From Earth. From Earth operates this store and website, including all related information, content, features, tools, products, and services in order to provide you with a curated shopping experience (the “Services”).
The following Terms of Service (“Terms”) set out your rights and responsibilities when you use our Services. By visiting, interacting with, or purchasing from us, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you should not access or use our Services.
Section 1 – Access and Account
To use the Services, you may be required to provide information such as your email address, billing, payment, and shipping details. You agree that all information you provide is true, current, and complete. You are solely responsible for maintaining the security of your account and any activity under it.
Section 2 – Our Products
Each From Earth surfboard is handcrafted. As such, slight variations in shape, finish, or appearance are part of the craft and not considered defects. Colors and finishes may differ slightly from what you see online due to device display settings.
We do not guarantee that any product will meet personal expectations beyond the specifications described. Product descriptions are subject to change at any time, and we may discontinue products without notice.
Section 3 – Orders
By placing an order, you make an offer to purchase. Orders are only accepted once confirmed and paid in full. Please review your order carefully before submitting, as cancellations may not be possible after acceptance.
All surfboard sales are final. We do not accept returns, refunds, or exchanges once a board has been sold. Please see our Returns Policy for details.
Section 4 – Prices and Billing
Prices are displayed in the currency indicated on our website and may change without notice. Prices do not include shipping, handling, customs duties, or taxes unless expressly stated.
You agree to provide complete and accurate billing and payment information. By submitting payment, you confirm that you are authorized to use the chosen payment method.
Section 5 – Shipping and Delivery
We ship surfboards with care, but once a product has been transferred to the carrier, title and risk of loss pass to you. We are not liable for shipping delays, customs processing times, or carrier issues. Delivery dates are estimates only.
If a board arrives damaged during shipping, you must notify us within 48 hours of delivery with photos of the damage so we can assist you in filing a claim with the carrier.
Section 6 – Intellectual Property
All content, images, designs, and branding on our website are the property of From Earth. You may not copy, reproduce, or distribute our materials without written consent.
Section 7 – Optional Tools & Third-Party Links
Our Services may provide access to third-party tools or websites. We are not responsible for the content, terms, or practices of those third parties. Use of third-party tools and websites is at your own risk.
Section 8 – Relationship with Shopify
From Earth is powered by Shopify, but all sales are made directly with From Earth. Shopify is not responsible for any transactions or disputes.
Section 9 – Privacy
Your personal information is handled in accordance with our Privacy Policy. Because our store is hosted by Shopify, certain information is also subject to Shopify’s Privacy Policy.
Section 10 – Feedback
If you provide us with feedback, suggestions, or reviews, you grant From Earth the right to use and share that content for business purposes without obligation to you.
Section 11 – Errors and Inaccuracies
We strive for accuracy but occasionally there may be errors in product descriptions, pricing, or availability. We reserve the right to correct such errors, even after an order is placed.

You may not misuse our Services, attempt fraud, violate laws, or infringe on our intellectual property. We reserve the right to suspend or terminate your access for violations.
Section 13 – Disclaimer of Warranties
Our surfboards and Services are provided “as is” without warranties of any kind, other than those required by law. By purchasing, you acknowledge the inherent risks of surfing and agree that From Earth is not responsible for personal injury or misuse of the product.
Section 14 – Limitation of Liability
To the fullest extent permitted by law, From Earth shall not be liable for any indirect, incidental, or consequential damages, including lost profits, resulting from your use of our Services or products.
Section 15 – Indemnification
You agree to indemnify and hold harmless From Earth, its employees, affiliates, and partners from any claims arising out of your misuse of our Services or products.
